"To help states, districts and schools that are ready to move forward in education reform, our government gives flexibility to the law in exchange for a real commitment to change," Obama said in a statement released by the White House on Thursday. "It is not intended to give states and districts respite from responsibility, but to release the energy to improve our schools locally." On Thursday, the White House circulated materials explaining that the administration will offer a "flexibility package." The No Child Left Behind law, passed by Congress a decade ago during the George W. Bush administration, requires regular standardized testing and the disaggregation of educational data by subgroup. It also states that just about 100 percent of students must reach proficiency in math and reading by 2014. As the deadline has approached, an increasing number of schools in each state have been labeled as "failing" under No Child Left Behind, in part because the reporting model focuses on raw scores, not improvement in scores. "Failing" schools face escalating consequences. States such as Montana and Idaho have resisted the ever-increasing performance targets, saying the law strains their capacities and leads to an overly broad portrayal of schools as underperforming. In light of those concerns, a White House fact sheet stated, the administration will allow states to request "flexibility through waivers of specific provisions" of No Child Left Behind, including the timeline for proficiency; "flexibility regarding school improvement and accountability requirements," which will allow states to set their own consequences for so-called failing schools; and "flexibility related to the use of federal education funds." Rural districts will have more freedom. A state that requests these waivers, the fact sheet said, will have to show that: It has already "adopted college- and career-ready standards in reading/language arts and mathematics" and administer "tests aligned" with these standards. The fact sheet does not detail what exactly such standards would entail, although U.S. Secretary of Education Arne Duncan has previously said states that haven't adapted the Common Core State Standards will not be barred from requesting waivers. It has set systems "of differentiated recognition, accountability and support," which includes turnaround plans targeted at the lowest 5 percent of the states' schools. It is "evaluating and supporting teacher and principal effectiveness" with a process that includes educator input. A senior administration official said on a conference call that this process must consider test scores. Beyond that, few details are available about the plan, such as the amount of funding over which states will have more discretion and the turnaround models that failing schools will have to use. No Child Left Behind has been up for renewal since 2007, and the administration released its own blueprint for the law in March 2010. But congressional gridlock has prevented formal reauthorization so far. Both Republicans and Democrats have introduced small components of a reauthorization -- with one measure involving charter schools passing last week -- but few have gained traction. In August, Secretary of Education Arne Duncan said Obama had approved plans to, in effect, reform the law without going through Congress: The secretary would waive specific provisions of the law in exchange for states agreeing to adopt favored reforms. Under No Child Left Behind, the Secretary of Education may waive provisions of the law for states in need, but he has no explicit authority to ask states to adopt reforms in exchange. The expanded waiver process is the administration's attempt to implement its own reforms, and the process comes with political risk. "The GOP is trying to develop a theme that Obama is overreaching in terms of federal power," said Jack Jennings, who heads the Center on Education Policy. "That's the argument they're using with the health care bill and the financial institution regulations. Now they're going to use it in education. [The administration is] playing into the narrative, and they know it." Already, GOP congressmen are criticizing the plan. In a floor speech Thursday, former Education Secretary and current Sen. Lamar Alexander (R-Tenn.) urged Duncan to "show restraint" with waivers. "Just because the secretary has every state over a barrel doesn't mean he should be tempted to use this opportunity to become a national school board," said Alexander. Rep. John Kline (R-Minn.), who chairs the House education committee, said in a statement that he "simply cannot support a process that grants the Secretary of Education sweeping authority to handpick winners and losers." On the other hand, a statement from Sen. Tom Harkin (D-Iowa) called the waivers the "best temporary solution." X Factor Auditions:These two hours, night two, were enervating. I feel weaker and less of a person after way too many bad singers and deluded human beings. At least there were two great singers in the mix who I won’t forget. The first hour of “The X Factor” in Miami was an utter waste of time except for the last five minutes when Melanie Amaro, a sweet 18 year old, showed up. She looked utterly unassuming but when she opened her mouth, it was a revelation. I actually saw her in the advance screener Fox sent out a few days back. I didn’t realize it would be shown tonight, not night one. Amaro’s evocative singing gave me goosebumps. That almost never happens. Even Simon Cowell gives a standing ovation? Assuming she can replicate this with other songs, she is surely someone who I could see win this competition. I also like her sweet, aw-shucks personality and I didn’t even need a back story. There were a few other promising singers who were given short bursts but let’s wait until the next round to get into them. A couple of folks who got through had me shrugging my shoulders, especially Marivana Viscuso, who sang “summertime” really loudly but with no soul. Hour two in Dallas didn’t start any better with a far greater ratio of bad vs. good. There’s a teen named Jonny Rogers, who was a bit warped and clearly not worthy of the $5 million. Simon thought he looked like Ken, as in Ken and Barbie. Dylan Lawson said he sold his truck to audition. He was beyond terrible.  This almost struck me as a put on. At the halfway point of hour two, we get 49-year-old hard-luck story Dexter Haygood channeling James Brown. He’s actually doing a pretty good imitation but Simon was not impressed. “It’s a tribute act,” he said. Simon gives him a shot to sing something a capella. He isn’t a particularly pure singer but he brings plenty of grit and character and gets through. After Melanie, I didn’t hear anyone memorable until Caitlyn Koch, a 21-year-old rugby coach. She brought tenderness and vulnerability to a slowed-down version of “Stop! In the Name of Love,” “You have an original, authentic voice,” Paula said. Then we get back to silliness: Xander Alexander. He’s a little nut and very deluded. He talks back. And he is a terrible singer to boot. I do have to give “X Factor” credit: it ended with this instead of a great singer, which is par for the course for “AGT” and “Idol.” The dude is in the end kind of sad. What's With The Boozy Divorcee? 'Whitney' Premiere: Within the first five minutes of "Whitney," the show's M.O. asserted itself and would not go away: relationships, love, sex and the lack thereof in this terrible modern purgatory we call singlehood. The real Whitney worries about this stuff and so too it seems will her fictional pawns. The standout victim so far in a cast of plenty is Whitney's friend Roxy “played by Rhea Seehorn”, who pops up for one reason only to act as boozy and divorced as possible. Sad and acid-tongued, Roxy wanders from scene to scene, dropping pearls of divorced-woman wisdom and chugging wine by the glass or better yet straight from the bottle. "Whitney" fully embraces this and all other stereotypes  just like that other Whitney Cummings original from this week, "2 Broke Girls" to the point you have to wonder if the real Whitney has ever actually met a divorced woman, or if her research ended at watching a lot of Lifetime. But it's too early to write the whole thing off. New shows often try to endear their characters to a suspicious public by exaggerating their "lovable" personality tics in the first episode : remember the weirdly ditzy Leslie Knope of "Parks and Rec" season one?: A little market research later, and the character's got a whole new set of lovable tics. With that in mind, we want to extend a hand to Roxy. She may be over the top, but who knows how long it'll last? Maybe she'll find an alligator-wrestler who sweeps her off her sad sarcastic feet with a well-timed dance routine that's not at all unmanly, and that'll be that. "If you say that we should not educate children who have come into our state for no reason than they've been brought there, by no fault of their own, I don't think you have a heart," he said. "I still support it greatly." The other candidates piled on Perry, criticizing him for his support for the in-state tuition bill. The bill allows some undocumented students, who went to high school in Texas and are working toward legal status, to qualify for in-state tuition at Texas state colleges. "You're sort of making this leap that unless the taxpayers subsidize it they won't be able to go," Rick Santorum said. "The point is, why are we subsidizing this? … Why should they be given preferential treatment as an illegal in this country?" "Yes, I would say that he is soft on illegal immigration," he added. Perry's statements on the border fence were also a point of contention. While the others said the border must be secured with a fence, Perry argued a fence would not work as well as boots on the ground. The most substantive question was about E-Verify, an employment verification program already used by federal agencies and contractors to screen for undocumented workers. Newt Gingrich said he would support making the program nationwide, as some House Republicans hope to do, and dismissed worries that it would cost employers. "We'd be far better off to outsource E-Verify to American Express and Mastercard and Visa because they actually know how to run a program like that without massive fraud," Gingrich said. We have always understood, encouraged, and appreciated the variety of avenues in which Rob’s voice and the message of God’s tremendous love has traveled over the past 12 years. Griffin plays a detective in Timoney's new squad, part of the so-called "Beef Trust" that is less than thrilled to see Timoney join the ranks. "I am part of the infamous Beef Trust. My character is Det. Augie Blando. He's like every squad room cut-up, keeps it light with humor," says Griffin. "He's one of the best characters I've ever been able to play. It goes in some fantastic directions. These writers are the best writing staff I've ever come across." Bello was similarly complimentary of the team of writes, which includes a retired NYPD gold shield detective. Griffin says we'll be surprised with the way the writers go with the series. "The way you'll be happily surprised is the way these relationships evolve. You see a hint of it in the pilot, as some of us start to warm up to her," says Griffin. "She's so undeniably good at her job. She's a forthright, brash person who does things her own way and you gotta respect it. It's wonderful the way the squad evolves into quasi-friendships and alliances. There's this underlyinig humor that ties us all together, it's really exciting to see. "Person Of Interest" Comment: We Are All In Control: What if a machine could predict murder? "Person of Interest," a new drama on CBS written and conceived by Jonathan Nolan “brother of Christopher”and produced by J.J. Abrams, centers that idea. John Reese “Jim Caviezel” plays the ex-government agent recruited to help Mr. Finch “Michael Emerson”, a mysterious rich man, use just such a machine to prevent violent deaths. We meet Reese when he's a bum on the subway “he looks a little like another character Caviezel has played Jesus”. Some street punks try to take his booze, and Reese explodes into action, neatly beating the shit out of all of them. This is the first time we see Reese at work, but it's not the last. If you enjoy watching highly brutal, seamlessly effective violence, this is definitely a show to watch. Reese, in minutes, completes such feats as taking out a room of armed men by shooting them all in the knees, launching a baby missile at a speeding car, and basically being a bigger bad ass than anyone else seems even capable of being. With a soft, beautiful voice that is always carefully modulated, Caviezel's Reese resembles nothing so much as an angel of death. "I don't particularly like killing," he tells some criminals later. "But I'm very good at it." Of course, it takes a little something for Caviezel to go from bum to grand high payback wizard. He's lifted from jail by the elusive Mr. Finch, a wealthy man who designed an intelligence system for the government in the wake of 9/11 to help predict future terrorist attacks. He now accesses that system to get a list of social security numbers of people who are somehow tied to violent murders -- either as victims, or as perps. Reese is Finch's way to stop these murders before they happen. Even more chilling than Reese's casual violence is the depth of surveillance the show either uncovers, or invents, depending how paranoid you already are. Each scene is intercut with grainy surveillance video of people in the city  walking down subways, combing their hair, kissing their children. Cameras, everywhere, watch everyone. "The machine is everywhere, watching with 10,000 eyes, listening with 3,000 ears," Finch tells Reese. And Reese is an even more highly focused instrument of such spying. He tracks the first person up on the list by breaking into her cell, tracking its GPS, listening in on her conversations via microphone, and putting a wireless camera on her. It's all too plausible. "Person of Interest" feels at times like a "Law and Order" style procedural with a classically Abrams mystery box at the center of the narrative. Still, this is a stark, dangerous universe, and Finch and Reese are far from your typical do-gooder heroes. The Blaine Gabbert: As reported last night, Blaine Gabbert is now Jacksonville Jaguars starting quarterback. Jaguar went to Luke McCown to start the season, because they knew they could control the game while the offense Gabbert collected more part-time, but after listening to McCown threw four against the Jets in New York and was on the bench in favor of rookie had to move. That being said, sooner than later I feel the Jaguars should open up the offense. Let Gabbert do what is comfortable, throw the ball from 3 + scale attack like the shotgun. He will be able to pass the ball in the center? Absolutely, but the modern NFL, is more than hunting, so it has become more friendly to the quarterback, who comes from a spread of transition to college. The team lack of effective weapons in the future of the game, but they have the tools to work with. When Marcedes Lewis is healthy, he's a great weapon in the passing game because he can line up anywhere and the defense can't pinpoint what he's doing. He can line up on the line of scrimmage and run/pass block, or run a route. That's Lewis' biggest asset, is the defense cannot single out what he's doing, he doesn't have a "tell". The team also has the "potential" of Zach Miller as a match up nightmare as a flex tight end. Mike Thomas is a good safety outlet, who's already been targeted in the passing game four times as much as the next receiver. Outside of that, the team leaves a lot to be desired however, which is why they'll need to line up wide and create natural spacing for their receivers to allow Gabbert room to work. If all else fails, then turn around and hand the ball to Maurice Jones-Drew. It will be fun to watch grow Gabbert, but just remember a few things as it grows: Gabbert is beginning to automatically launch the season; Gabbert will make mistakes, probably many of them. Republicans will come out ahead in Pennsylvania in every election. The way Democrats win, they have two big cities with huge concentrations of voters and then overwhelm the rest of the state.” Leach, who yesterday held a press conference with Good Government leaders to challenge the plan, said he appreciates Santorum’s candor. “Sen. Rick Santorum openly admitted that Corbett's election rigging scheme is just that. This ends any pretense that this plan is about good government or fairness. This is simply about making sure the results of future elections are no longer in doubt. How can anyone who believes in democracy support this?” Leach asked. “I encourage Gov. Corbett to publicly admit the reasons for his support of this bill, and to stop using ridiculous rhetoric to shield its true intentions.” The electoral vote-splitting bill would change the electoral vote process by splitting up the state's 20 electoral votes and allocating them according to congressional district. The current system awards all of a state’s electoral votes to the winner of the popular vote. Yesterday, Leach said that he hopes that by shedding light on the motivation behind the Vote-Rigging Bill and the negative effects that could arise from its implementation, Pennsylvanians will realize that it is not the right course of action for the Commonwealth.
